Congress Passes Ban on Pre-Dispute Arbitration Clauses Covering Sexual Assault and Harassment Disputes
On Thursday, February 10, 2022, both the House and Senate passed H.R. 4445 which will ban the use of arbitration clauses and disallow joint, class or collective action waivers for sexual abuse or harassment disputes, unless the employee/complainant consents to arbitration, but only after a legal dispute arises. The Bill still requires the President’s signature before becoming law.
